Israel faces international justice
Dr. Mustafa Yusuf Al-Liddawi
Some may not believe in international institutions, trivialize the International Court of Justice, and expect no good or justice from it. They may view resorting to it as a waste of time, exerting effort with no merit.
In their eyes, it is no different from other United Nations institutions and the Security Council, all subject to American and British influence, intervening in decisions, appointing judges, imposing agendas, manipulating and altering content, pressuring judges, and controlling case trajectories.
Despite the shortcomings evident in international institutions, including the International Court of Justice, its arbitrary decisions, blatant inconsistencies, lack of professionalism and transparency in its filed cases, and its subjugation to politics over law, it holds a significant and remarkable judicial precedent.
In July 2004, it condemned the Israeli government when considering the legitimacy of the separation wall it built, dividing the West Bank and Jerusalem. The court deemed it a form of racism and demanded its removal.
It also labeled Israeli settlements encroaching on West Bank territory as illegitimate, calling for their dismantling and the withdrawal from the occupied West Bank.
Based on the principle that we should resist the Israeli enemy through all possible means, never belittling any method, however simple or symbolic, supporting and advocating for this trial is wise and reasonable. Supporting South Africa in its bold pioneering step might set a new legal judicial precedent.
This could be a foundation for continued trials against the Zionist entity. It is essential to recognize that the defendant before the International Court of Justice is not only the Zionist entity but also its major allies like the United States and Britain, who might face condemnation for their favored upbringing and misguided actions.
Regardless of the court’s decision, supporting or opposing the Palestinian cause, being fair or unjust to the Palestinian people, the mere indictment of the Zionist entity for genocide before a court it boasts of as fair to the Jewish people and supportive is significant. The court, which stood with the Jewish people, judged them, and investigated the Holocaust, is now reviewing a case accusing Israel of genocide.
Moreover, the court sessions are broadcasted live in multiple languages for over thirty continuous hours. They listen to the arguments of South African state attorneys who prepared their cases, presenting them with audio-visual evidence. This allows the world to witness Israel’s crime against the Palestinian people in a documented, audible, visual, and proven manner. It calls upon the world, claiming humanity and civilization, to fulfill its legal, moral, and human responsibilities.
The Zionist enemy understands the importance and danger of the court’s decisions, the impact on its image and credibility, and how they may reveal the truth of its crimes. It appointed top Israeli and international lawyers to defend it, responding to the charges.
International allies like the United States and Britain sense the danger of the court’s decisions. They express their anger, criticize its judges, question its jurisdiction, and deny the validity of accusing the Zionist entity of genocide, arguing that it defends its safety, the security of its settlers, and is subjected to threats from its surroundings.
While thanking South Africa for its courage and morality, it is a plea to all Arab and Islamic regimes, international human rights institutions, and organizations to stand by the Palestinian people. Supporting this cause does not cost them blood or money, no sacrifice or hardship. Instead, it involves providing support and assistance, trust, and belief in the justice of the Palestinian cause and the oppression of its people.
Any weapon that hurts and pains the Israeli enemy is a serious and effective one. We should not underestimate it or belittle it. Its expected impact and desired results may be a turning point in the international conscience, urging a halt to the Israeli war and aggression on Gaza, prosecuting the Zionist entity and its leaders as war criminals, and achieving justice for the Palestinian people, compensating them for the harm and injustice they suffered.
