Documents published on the ICC website show that Israel also asked the court to order the suspension of its war crimes investigation. The documents are dated May 9 and signed by Israeli Deputy Attorney General Gilad Noam.
On November 21, 2024, the ICC issued arrest warrants for Netanyahu and Gallant. The court accused them of committing war crimes and crimes against humanity during Israel’s ongoing genocide in Gaza.
Israel denies the allegations. It claims the ICC has no authority to investigate the Gaza case and has appealed the arrest warrants.
In April 2025, the ICC Appeals Chamber ruled that the Pre-Trial Chamber, which issued the arrest warrants, must review Israel’s objections to the court’s jurisdiction and the legitimacy of the warrants.
The court has not yet outlined the review process. It has also not set a deadline for deciding whether to cancel the warrants or suspend the investigation.
Israel launched its genocide in Gaza on October 7, 2023. Since then, over 52,862 Palestinians have been killed and 119,648 injured, according to health authorities. Israel also launched a starvation campaign against over two million Gazans, pushing the enclave into severe famine, with humanitarian agencies warning of catastrophic food shortages.
